Parents to Demand Answers about Muslim Lesson at Lumberton School Board Meeting March 7th, 2013 at 7pm

Parents to Demand Answers about Muslim Lesson at Lumberton ISD School Board Meeting March 7th, 2013 at 7pm. Before the meeting starts, anone can sign up to speak to the school board. This is In response to the High School lesson in Lumberton, Texas that made outrageous claims to the students such as terrorists should be called freedom fighters and Muslim Burqas are just a fashion statement instead of an oppressive object that, if not worn, could mean the death penalty for women in some countries. I am all about students learning other cultures, but this is told far. It is biased, offensive, and does not even show the truth about Muslim things like Burqas. The lesson might have had good intentions but what ended up happening was wrong. This lesson should be immediately suspended and an investigation made into the lesson and what needs to be changed to make sure these mistakes do not happen again.

Senator Patrick says Lumberton ISD is lying about Muslim Lesson

Yesterday, Texas State Senator Dan Patrick launched an investigation after a photo surfaced of students wearing Muslim Burqas and being taught to call Muslim terrorists 'freedom fighters.'  The school defended the lesson by claiming it was a state mandated lesson. It was just announced that Senator Patrick has dropped the investigation because it has been determined that the school lied about the content of this lesson being state mandated. In fact, the contents of this class is something that the Lumberton teacher and/or administration has developed the content of this class and not the state, therefore this is a local issue and not a state issue. The school will have some explaining to do at the next school board meeting.

Update: After Muslim Burqa Lesson, Student Pulled From Lumberton School - not CSCOPE, or was it? - Sen. Patrick Investigating

I took down the original picture and put one up with faces blurred
Update: After Muslim Burqa Lesson, Student Pulled From Lumberton School - minor students cried today after being forced to sign incident report about what happened without parent notified or allowed to be at the meeting, parents furious - the school says this lesson seems to be a Lumberton lesson and not CSCOPE lesson, but CSCOPE Experts say it was CSCOPE influenced - Senator Dan Patrick Investigating

There have been lots of updates after I posted this article this morning: Lumberton ISD (Texas) Students Told to Wear Muslim Burqas in CSCOPE High School Lesson http://www.texasconservativerepublicannews.com/2013/02/lumberton-isd-texas-cscope-students-burqas.html

Here are the updates:

One parent contacted me and said that he pulled his kids out of Lumberton schools 2 years ago because of this exact Islam lesson

Another parent contacted me and told me that her child called her from the school crying because she had to go to the Principal's office this morning and sign an incident report statement staying that they were not forced to wear the Burqas. The parents are now even more furious because they were not informed or asked to be present when their minor child was told to sign a potentially legal form. One parent got a lawyer who said the school was in violation for not letting the parent be present.

It was confirmed that this was a geography class and not a history class.

The teacher I hear was upset that she even had to teach the lesson and told the students she did not agree with it so I am not out to bash the teacher. Clearly this lesson has been forced into the classroom by someone and it needs to be corrected.

State Senator Dan Patrick has today called for an investigation into this lesson.

National News has picked up the story including Todd Starnes of Fox News, Alex Jones Prison Planet, and I got a call from MSN.

It was also confirmed by a parent this morning that the students were not FORCED to wear the Burqas but they were brought as Larry of the lesson and students were asked to try them on. Here is the worst part though, It was also confirmed that the students were told to call terrorists 'freedom fighters' and also the students were taught that Burqas are really just a fashion and the students were not taught that they are a form of oppression and women can even be put to death for not wearing one. Also, it was confirmed that the students were asked to do a report on Egypt that portrayed democracy as bad.

This is OUTRAGEOUS! Look, I am ok with students learning other religions and regions as part if a history or geography class. It sounds like this was the INTENT of the lesson and I think the state of Texas has lessons that teach students different religions and regions. That is ok. What is NOT ok is what happened here and what this lesson has become over the years. Somehow, this lesson that was supposed to talk about different religions ended up only talking about Islam. Burqas were brought and presented as a fashion instead of an oppressive object. The students were asked to call terrorists freedom fighters. This is wrong and the Lumberton School Board needs to take action. I do not believe that the school board knew this was going on. I do not even know how much the superintendent knew of what was going on because I think, or hope, that if he did he would have asked the teacher to make sure it was fair and balanced instead of a lesson slanted in favor or Islam.

Also, although Texas CSCOPE has had major issues because of Islam lessons in schools, this Muslim Burqa lesson was not part of CSCOPE (sccording to the school) and it is a lesson that Lumberton ISD has been doing for years. John Griffing from WND.com believes the school is covering for CSCOPE and he believe this Muslim lesson was influenced by CSCOPE.

Here is a statement from John Griffing about this Lumberton lesson and CSCOPE:

CSCOPE has been in place for the last 8 years, and due to its influence in classrooms, it is premature to rule out CSCOPE as a culprit philosophically, if not materially in this case.

Teachers, as we know from user agreements supplied by Mary Bowen at the hearings on January 31st, are required to teach CSCOPE lesson content exclusively. What this means from an application standpoint is a matter for discussion, but would anyone attempt to argue that prior to CSCOPE such incidences would be as likely?

It certainly seems as if we should be cautious in throwing out CSCOPE as a factor in this case.

TESCCC 2012 - Contract, from Mary Bowen:

“To support implementation of this detailed curriculum, districts must have processes and people in place to insure that there is sustained monitoring of the curriculum and that individual teachers do not have the option to disregard or replace assigned content.”

How exactly can we separate CSCOPE--used by Lumberton ISD--from the current situation? After someone is caught in the commission of an unethical act, can their testimony be trusted?

Lumberton does not deny use of CSCOPE, but does deny it as a factor in this case. Again, it is questionable to throw out CSCOPE as a factor simply due to denials coming in the wake of discovery. I don't know which is worse. The lesson described closely parallels CSCOPE content, and I referenced some of this content in my original article. It's the chicken or the egg. Either way, Lumberton is in violation of an SBOE resolution disallowing the promotion of Islam in classrooms.

Lumberton ISD (Texas) Students Told to Wear Muslim Burqas in CSCOPE High School Lesson

Update: After Muslim Burqa Lesson, Student Pulled From Lumberton School - minor students cried today after being forced to sign incident report about what happened without parent notified or allowed to be at the meeting, parents furious - the school says this lesson seems to be a Lumberton lesson and not CSCOPE lesson, but CSCOPE Experts say it was CSCOPE influenced - Senator Dan Patrick Investigating

original story:

Wow, I don’t even know what to say. I just read a news story by John Griffing on WND.com about my very own Hometown High School in Lumberton, TX (Lumberton ISD) making students wear Muslim Burqas as part of a History class this past week. (picture displayed below is from a Lumberton Student taken when they had to wear Burqas in class)

I took down the original picture and put one up with faces blurred

Update: After I wrote this article I was contacted by a Lumberton resident with a student in this class, she said this Burqa incident was part of the regular CSCOPE lesson taught to the students and not just some extra curricular activity or student led project. The students were not forced to wear the Burqas, but the Burqas were there as part of the lesson and students were encouraged to try them on. That being said, it was confirmed that everything else being reported as happening in this Lumberton class are true, including the students were taught not to call a terrorist a terrorist and instead call them freedom fighters. Also, the teacher I hear was upset that she even had to teach the lesson and told the students she did not agree with it so I am not out to bash the teacher. Clearly this lesson has been forced into the classroom by someone and it needs to be corrected. This is outrageous!

Earlier this Month (February 2013), BEFORE this Burqa lesson was ever taught, I first learned that Lumberton ISD uses CSCOPE and I wrote this article: Lumberton ISD uses Liberal CSCOPE that teaches Allah is God and Boston Tea Party was Terrorism like 9/11

Right after I wrote that article, I went to the Lumberton School Board meeting and spoke to the School Board at the beginning of the meeting. I explained to the school board the problems with CSCOPE and asked them, at least, to have a hearing about CSCOPE and whether or not it should still be used at Lumberton ISD. The school board members did seem concerned and asked the Superintendent questions about CSCOPE. The Superintendent, John Valastro, assured the Board that the CSCOPE program was not used very much and they had not run into any issues with bad lessons getting taught by teacher.

Not even a month after I was assured at the LISD School Board meeting that there were no CSCOPE lesson problems at Lumberton ISD, I get emailed this article from WND with a picture of Lumberton ISD students in Burqas with quotes from students saying they were even told by the teacher that “we are going to change your perception about Islam” and the teacher in the Burqa lesson, according to a student, also said, “I do not necessarily agree with this, but I am supposed to teach you that we are not to call these people terrorists anymore, but freedom fighters.”

The lesson teaches that Burqas are just an alternative dress style that Muslims wear when in reality, women in Muslim countries are oppressed and FORCED to wear these Burqas or face even possibly death. At the end of class, the students were assigned to write a paper about Egypt. According to one student, they were instructed to discuss “how Egypt was a good country until democracy took over, and that things were finally corrected when the Muslim brotherhood came into power.”

I believe Mr. Valastro and do not think he or the School Board deceived me. I do think they probably being deceived though. I do believe there have been bad lessons that have not been brought to his attention and I believe some teachers use, and are even forced to use, CSCOPE lessons on a regular basis instead of just minimally.  That is the problem with CSCOPE though. There is no transparency! Everything is online and there are thousands of lessons that teachers can pick to use without even having to get it approved. Some of these lessons ARE bad lessons. Even the Superintendent and the school board did not know about what was going on with CSCOPE at LISD. Hopefully, now that this Burqa incident has happened and will be on the news all across America, there will be some action taken regarding CSCOPE being taught at Lumberton ISD. Yes there are legislative fixes that should be coming this year, but until then, Lumberton ISD should really consider having a hearing or something to discuss CSCOPE being used at LISD and whether or not it should even be used anymore until the problems get fixed.

True The Vote: Obama Campaign Targeted Citizens Trained To Prevent Voter Fraud In Ohio

the following article is is from my friend Brandon Darby posted at BigGovernment.com and also at Texas GOP Vote here: http://www.texasgopvote.com/issues/stop-big-government/true-vote-obama-campaign-targeted-citizens-trained-prevent-voter-fraud-ohio-0051601

True The Vote: Obama Campaign Targeted Citizens Trained To Prevent Voter Fraud In Ohio

Millions of Americans were stunned after watching Hamilton County, Ohio voter and Organizing for America volunteer Melowese Richardson proudly admit to casting multiple ballots for President Barack Obama. Recently surfaced emails expose how Organizing for America worked to monitor and block any possibility of a citizen volunteer catching others like Ms. Richardson in the act.
In an exclusive interview with Breitbart News, True the Vote shared emails between Obama staffers discussing targeting specific individuals they believed were associated with True the Vote in Hamilton County, Ohio. Official records obtained by True the Vote indicated that the private citizens on the Obama target list were poll clerks hired by the county--not observers placed by candidates.
The email’s author, current Consumer Financial Protection Bureau employee Scott Pluta, stated with certitude that these people were affiliated with True the Vote locally.
“There are a number of elements to this finding that are concerning,” True the Vote President Catherine Engelbrecht said. “The idea that an incumbent presidential campaign would build target lists on citizens that are specifically trained to detect fraudulent behavior in the polls is truly unnerving. You would think that kind of story would be told in developing nations, not the United States.”
The election watchdog reasons the Obama campaign compiled such precise lists with well-timed open records requests for incoming emails to the Hamilton County Board of Elections from known True the Vote affiliates in the area.
“There’s nothing illegal here, it’s just unsettling to know that a candidate for public office dedicates time and effort to remove citizens that are well-versed in Ohio election code from the process,” Engelbrecht said. "If long lines at the polls are truly the civil rights struggle of the 21st Century, perhaps it’s best we don’t try to kick out the people who actually keep the line moving.”
Prior to the 2012 presidential election, True the Vote was subjected to numerous attacks from partisan organizations and media figures over concerns that its operations were contributing to alleged “voter suppression.” A quick search yields over 35 full-length segments from MSNBC prime-time programming regarding the citizen watchdog. Engelbrecht argues these attacks serve a larger purpose:
"Voter suppression is a political construct. Washington cannot wrest the responsibility of conducting elections until it chills citizen participation on the local level. Election Day bullying and media campaigns designed to label volunteers as racist are two examples we’ve seen so far. This is unacceptable. True the Vote will challenge this effort directly in 2013."

Florida Governor Rick Scott Reverses Position On Obamacare

the following article is is from my friend Brandon Darby posted at Breitbart.com and also Texas GOP Vote here: http://www.texasgopvote.com/issues/stop-big-government/florida-governor-rick-scott-reverses-position-obamacare-005166

Florida Governor Rick Scott Reverses Position On Obamacare

Florida Governor Rick Scott announced Wednesday evening he had made a deal with the federal government and would now accept Obamacare's Medicaid Expansion, the initial implementation of President Obama's Affordable Care Act.
Governor Scott had previously been a champion of Tea party and conservative grassroots efforts to prevent the expansion of Medicaid in the state of Florida. He announced this policy reversal in a hasty press conference.
Inside sources had informed Breitbart News of the Governor’s intention to announce the reversal of his stated ideals and policy decisions during a press conference Thursday morning. After the Florida chapter of Americans for Prosperity Director Slade O’Brien spoke out on the matter, Governor’s Scott’s office changed the time of the press conference to Wednesday at the end of the workday.
Tarren Bragdon, CEO of the Foundation for Government Accountability, a prominent Florida-based free-market think tank, told Breitbart News, “It is extremely disappointing to have Governor Scott do an about-face on his signature issue."
He continued, "The grassroots fight against the implementation of Obamacare, in large part, began with Governor Rick Scott and Conservatives for Patients’ Rights in 2009. He set this effort up and basically said there is no way the Obamacare’s expansion of Medicaid will happen on his watch.”
"The governor will now couch his policy reversal as 'I’ll not stand in the way of the expansion of it, if it’s introduced,'" Bragdon further stated. Slade O'Brien and his Florida Chapter of Americans for Prosperity released this statement:
Governor Scott’s announcement today is extremely disappointing. Governor Scott had been a national leader in the fight against President Obama’s healthcare takeover. He was elected because of his principled conservative leadership against ObamaCare’s overreach, and led the charge, with Attorney General Pam Bondi, to take ObamaCare to the Supreme Court. But today he came out in support of the Medicaid expansion he vowed to oppose.
The expansion of Medicaid has been at the forefront of states’ efforts to stop the implementation of Obama’s health care initiatives.

City of Lumberton, TX Bans Republican Women of Hardin County from Meeting in Community Center

The City of Lumberton, TX and City Manager Steve Clark have kicked out the Hardin County Republican Women's group from using the Lumberton "Pete Trest" Community Center.

The Community Center is a city public building that was built for the community to use. There is of course a rental fee that must be paid to use the building to cover building expenses and to pay for a city employee to be at the events at the community center.

For nearly every month in 2012, the Hardin County Republican Women's group paid to rent the building for their once a month meetings. Even though it is a women's group, it is the only Republican group that meets on a monthly basis in Hardin County and men are welcomed. I went to some of the meetings at the Lumberton Community Center last year.

Everything was just fine. The rent was always paid, the city never had any problems, and the meetings were getting better and better. Just a couple of years ago, most elected officials in the county (Hardin County) were Democrat. Now most elected officials in Hardin County are Republican. This Republican group has played a big role in helping grow the Republican Party in Hardin County. The Republican Women of Hardin County group is a part of the Texas Federation of Republican Women.

The County and City still have some old Democrats who do not particularly like to see their good ol boys lose elections or be forced to switch to the Republican in order to stay in office in the now Republican County. Apparently, the Lumberton City Manager, Steve Clark, does not like the progress that the Republican Women's group has made either, or at least he does not want the Republican Women's group to meet at the Community Center anymore. The question is why? I don't know whether or not the city manager is one of these old Democrats, but I do know for a fact that most of the local city officials and city manager tried to stop Governor Rick Perry from coming to Lumberton last year to endorse State Representative James White. James White won instead of Mike Hamilton (who most of the Lumberton city officials openly endorsed). Maybe they are still mad about that?

Here is what we know for sure. For nearly every month in 2012, Lumberton City Manager Steve Clark allowed the Republican Women's group to rent the Community Building. He accepted their money. He signed off to every monthly request to use the building. He never once objected to the Republican group using the facility.

Well, out of nowhere, right before the January 2013 meeting, the City Manager told the Republican Club they are no longer welcome to use the community center ever again for a once a month meeting.

I contacted the Hardin County Republican Women President, Janis Holt, and asked the reason they were banned from using the facility. Janis Holt said that the City said that there was a policy that does not allow anyone to use the community center for monthly meetings. They said that the Community Center could only be used for random parties or events and therefore the Republican Women could not use the center for scheduled once a month meetings. As a disclaimer, I want to say that Janis Holt did not ask me to write this article. She would probably actually rather me not write this article because it might stir some things up and she does not want the Republican Women's group to get hurt. I understand that and so I want to make sure to include this disclaimer that Janis Holt did not ask me to write this. I am writing this article on my own because, well, I have a habit of sticking my neck out there because I believe that shining light on the government doing wrong is a good thing to do even if I have to take some heat for it. What happened here is wrong and I personally felt that it needed to be exposed.

First of all, what kind of community center does not allow organizations to meet at the community center and pay the fee just like any other event?

Second, it seems as though this policy is bogus and was made up to kick out the Republican Club. If this was a real policy that had been in effect for years then why did the city manager allow the Republican Club to use the community center for nearly a year? Is he that incompetent? Why didn't the City Manager speak up after the second monthly meeting last year instead of waiting until several meetings and a year later? I do not think he is so incompetent that he did not know the Republican Group was meeting on a monthly basis. He knew they were and he had no problem with it. The city manager did not speak up sooner because it was not against policy for the Republican club to use the community center for monthly meetings. It only became a policy after, I can only assume, the the City Manager did not like the last election results or got tired of the Republican Women's group becoming more successful. He can't stop the group from meeting, but he can ban them form meeting in the community center.

I have been asked why I believe that this "new" policy and the city manager's actions are targeting the Republican club only and not any other clubs. Well, the answer is simple. The Hardin County Republican Women were the ONLY group using or requesting to use the community center for monthly meetings. So, if the Republican group was the only group meeting at the community center, then logically this new policy banning monthly meetings was directed at, and only affected, the Republican group monthly meetings at the community center.

The City of Lumberton, TX has some major problems. This is just one of more recent problems but it is very revealing. The City Manager kicked out the Republican club from the COMMUNITY RENT CENTER for crying out loud. A once a month meeting is just too much for the center to handle I guess. Maybe the City Manager should rename it as the non-community center.

Confederate Memorial on MLK in Orange, TX Angers NAACP

Slavery was bad... it still is happening and it still is bad.... no one is disputing that. The thing about war though is that it usually is started by the powerful people and then lots of not powerful people get sucked into it and lots of innocent people die on both sides. The Civil war was over slavery between the big guys, but for all the regular people fighting, most of them did not own slaves and had no interest in owning slaved. Many people fought just to fight for their state or against the north or against the south or to right with their brother who joined. Did all the British solders that were fighting against the colonist in the American Revolution hate Americans or were many of them fighting just because they were British and had to fight for their side? Look, it does not mean you agree with slavery just because you are proud to be southern or want to honor your relatives who died in the civil war fighting for the Confederacy. In America we have a Constitutional right to freedom of speech and everyone is entitled to it. So if this guy wants to build a Confederate Memorial on a major intersection so that people driving through the city can see it then so be it. Soldiers have died to protect Freedom of Speech just as soldiers have died to end Slavery.

the story below is from KBMT 12 News:
http://www.12newsnow.com/story/21192179/confederate-memorial-to-be-built-on-mlk

ORANGE - Granvel Block of Orange says he's related to at least 17 Confederate soldiers.
"My great grandfather was a Confederate veteran," he told 12News Wednesday.

He and his organization, called the Sons of Confederate Veterans, want to honor their ancestors by building a Confederate memorial in Orange. It would look similar to the Jefferson Memorial in Washington, D.C., and it would be surrounded by 26 different Confederate flags.

"It'll be there for an educational purpose, to show the public the misconception that a lot of people have that the only flag is the battle flag," Block said.

But the memorial will be at the corner of Interstate 10 and MLK, and it's the location that has people talking.

"I think the location could be offensive, it seems to be in bad taste," said Orange resident Philip Cooper.

Orange City Council member Theresa Beauchamp finds it offensive, saying, "Everyone has their freedom of speech, but let that (part of history) be gone and forgotten. We do not need to stir up controversy in this town."

Block says his organization never intended to "make a statement."

"It was just a matter of fate that this particular spot became available," he said.

Block says the complaints are unfounded.

"We are a very diverse group, we do not have prejudices," he said.

Several Orange residents and the Orange division of the NAACP plan to voice their concerns to the City Council. But the property is paid for, and Block says the memorial will be built, possibly completed as early as April.

TSA Detains 3 Year Old in Wheelchair

More TSA News...

the following article is from Todd Starnes of Fox News Radio:

A Missouri couple is furious after the Transportation Security Administration detained their wheelchair-bound three-year-old daughter, took away her stuffed doll, and refused to allow them to videotape agents patting her down.
“They treated her like a criminal,” said Nathan Forck. “And by extension they were treating us as criminals.”
The TSA did not return phone calls or emails seeking comment.
The incident happened on Feb. 9th at Lambert-St. Louis International Airport.
Forck and his wife Annie, along with their three children were heading to Disney World for a family vacation. Lucy, their three-year-old, has Spina bifida and is confined to a wheelchair.
The family managed to make it through the TSA checkpoint without any problems. But as they prepared to walk to their gate, a TSA agent pulled aside Lucy for additional screening measures.
“They specifically told me that they were singling her out for this special treatment because she’s in a wheelchair,” he told Fox News. “They are specifically singling out disabled people for this special scrutiny. It’s rather offensive to me as a father of a disabled child.”
The agent said they needed to pat down Lucy and swab her wheelchair – even though both had already gone through the checkpoint.
Forck’s wife started filming the entire episode – over the objections of the TSA agent.
“You can’t do touch my daughter unless I record it,” she can be heard telling the agent.
The agent replied by telling the parents “It is illegal to do that.”
“The problem is, I don’t allow anyone to touch my little daughter,” Annie Forck said.

The Forcks refused to stop filming and soon, the young family was surrounded by TSA agents – one specifically assigned to guard Lucy.
“It’s your worst nightmare,” Forck said. “It’s bad enough they are demanding they want to pat down my child and didn’t want me to videotape it.”
Forck, who is an attorney, said he knew enough about the law to know it was perfectly legal to videotape.
“That set off alarm bells,” he said.
At some point the agents confiscated Lucy’s stuffed toy, “Lamby” – reducing the child to tears.
“She was crying for her stuffed animal which they wouldn’t let her have for the longest time,” he said. “It’s only about a half foot long. It’s a lamb down that talks – but she loves it.”
As TSA agents discussed what they were going to do, the video shows Lucy weeping uncontrollably.
“I don’t want to go Disney World,” she screamed as her parents tried to offer reassurances.
Forck said he could not understand why the TSA was so adamant about not allowing them to film their daughter’s pat-down.

Bankruptcy Courts Part 7 - General Motors Revisited by Judge Robert Gerber... Oops

the following article is from Bob Price posted on Texas GOP Vote: http://texasgopvote.com/issues/stop-big-government/bankruptcy-courts-part-7-general-motors-revisited-judge-robert-gerber-oops-005138

Bankruptcy Courts Part 7 - General Motors Revisited by Judge Robert Gerber... Oops

Stormy Skies for Judge Robert Gerber and GM BankruptcyIs 44 days too fast to move a bankruptcy the size of General Motors (GM) through the courts system without missing something major?  Apparently so, as Judge Robert Gerber, in the Southern District of New York (SDNY) Bankruptcy Court, is now having to revisit this case because of some potentially damaging issues involving the Canadian subsidiary of GM and alleged improper transfer of assets to hedge funds. I have previously reported on the GM bankruptcy and spoke with Judge Gerber about the Canadian lock-up funds in San Diego last year.
Now, an American Thinker article by Clarice Feldman is taking a look at this case which she claimed, "turned American property law on its head to pay off the UAW."  It now appears this GM bankruptcy may well be in danger of being overturned because of a potentially illegal transfer of funds from GM to the Canadian subsidiary in the form of a "lock-up agreement".
Gerber claims to not have been aware of this lock-up agreement.  I asked him about it at the NCBJ conference in San Diego in October.  At first he started to say, "I am not aware..." but then he caught himself and said that he could not comment on a matter that would be appearing before his court the following week.  The following week ended up being much later as Hurricane Sandy struck New York before the hearing date.
Free Beacon reported that Judge Gerber spoke with them a few weeks after I spoke with him.  Their analyst said,“The judge has made it very clear that he is greatly dissatisfied with the process.  He’s basically implying that GM hid it from him and that reopening the sale is a possibility.
According to Bill McMorris at Free Beacon, this is a very serious situation with far reaching consequences:
If Gerber takes that course the company could be forced to return the $30 billion taxpayer bailout that it received through the course of bankruptcy, on top of the new liabilities.[snip]
The company is taking the possibility of a negative ruling from Gerber very seriously. GM attorneys filed court documents saying that the lawsuit "could create a chaotic situation for GM Canada, spawn new litigation in other forums, and potentially provide a windfall to the noteholders."
The bankruptcy expert said if the two sides cannot come to an agreement on Thursday, Gerber could preside over one of the most historic rulings in bankruptcy court history."This has tremendous implications for future of American business and bankruptcy precedent," he said. "It means more than just GM -- this is the rule of law and how creditors are treated in the United States legal system."
Was Judge Robert Gerber asleep at the wheel during GM BankruptcyWas the presiding judge asleep during the GM bankruptcy case court proceedings?  In July, Robert Gerber told the Wall Street Journal, "When I heard about that, it wasn't a surprise, it was a shock."  He went on to say, "When I approved the sale agreement and entered the sale approval order I mistakenly thought that I was merely saving GM, the supply chain, and about a million jobs. It never once occurred to me, and nobody bothered to disclose, that amongst all of the assigned contracts was this lock-up agreement, if indeed it was assigned at all.
According to the WSJ article:
"The judge has been careful to say that he doesn’t know if he would have rejected the sale altogether if he knew about the deal, which was disclosed in a U.S. Securities and Exchange Commission filing the same day GM sought Chapter 11 protection. But he said he might have added a provision that made it clear he wasn’t approving the transaction with the hedge funds."
"The $367 million payment was divvied among several well-known hedge fund managers, including Fortress, David Tepper’s Appaloosa Management LP and Paul Singer’s Elliott Management. Appaloosa has since sold its bonds and is no longer involved."
"... which was disclosed in a U.S. Securities and Exchange Commission filing the same day GM sought Chapter 11 protection"?  So this was public record at the beginning of the GM bankruptcy case?  How did Gerber miss this?  Perhaps a rush to judgment to make the case in 44 days!
The U.S. Treasury department, which was heavily involved in this entire process did not answer any questions put to it by Free Beacon in December.  GM also refuses to comment on an on-going case.
The entire GM Bankruptcy process was handled in 44 days.  Yet, this small piece of the case, missed in the hasty judgment in 2009, has dragged on for over six months.  I thought major corporate Chapter 11 bankruptcy cases were "melting ice cubes" that demand prompt attention, according to the experts I spoke with at the National Council of Bankruptcy Judges conference in San Diego.
When I spoke with Judge Gerber at the American Bankruptcy Institute Winter Leadership Conference in Tuscon in December, he told me "My job is to get creditors paid and put people back to work."  That is odd...  I thought a judge's job was to fairly and consistently apply the law to the facts of a case.  Perhaps Robert Gerber is more of a frustrated social worker than a judge?
In this case, either Gerber had the wool pulled over his eyes by a scheming Obama Administration, or he was simply moving too fast to be able to do his job properly.  Who's job was it to search the public records for other important filings related to this matter?  In any case, the GM bankruptcy is a mess and Judge Gerber now has an opportunity to do the right thing.
In the next post in this series I will take a look at some of Gerber's other interesting Chapter 11 bankruptcy cases in the SDNY.  American Airlines' bankruptcy is in the news this week.  And there are troubling issues in the Chicago Tribune and LyondellBasell cases that could shake the very foundation of your stock investment strategy.

President Jimmy Carter Thinks Navy Soldiers are Mentally Retarded?

So I was reading this article on Fox News about a Georgia inmate, Warren Lee Hill, who is set to be executed. This inmate killed two different people and he should be put to death. Not everyone thinks that society should be safe from violent murderers though. Some inmates play the "retard card" and claim that they should not be put to death because they are mentally disabled even though a judge and jury have already determined that they are not mentally disabled. Some people actually believe this inmate trick though. Former President Jimmy Carter is one of them. Carter is speaking up in support of this Georgia inmate. Carter believes the inmate when he says he is retarded. Inmates don't lie right? The former President has not seen any recent evaluations by doctors. He has not seen testimony of the trial where the inmate's friends and family say he was the leader of the family. Oh, and get this, the inmate was a soldier in the Navy. I am pretty sure you cannot be mentally disabled and be in the military. Soooo, if former President Carter believes that this man is mentally disabled, then that means Carter also must think the Navy has mentally retarded soldiers right?

List of 2013 Texas House and Senate Committee Members with Email and Phone Numbers

Texas Wingnuts has posted a list of which State Representatives are on House Committees and which State Senators are on Senate Committees. This list includes each legislator's contact information list email and phone number. This list will be very useful when a bill is getting voted on in a committee and you want to contact the members of that committee.

The following list is from Texas Wingnuts http://texaswingnuts.com/2013_Committee_list.html

2013 Committee list

Below is a list of contact information for all Texas house and Texas senate members organized by committee.  I use this to contact the committee members when hearings are scheduled.  For those of us unable to attend the hearings in Austin, this is the next best thing.
